General Terms and Conditions

Scope

These General Terms and Conditions (GTC) exclusively apply to the business relationship between Cheetah Stories SA (hereinafter Cheetah Stories SA) and the customer (hereinafter customer or you) for the ordering of goods via the online sales platform at https://www.cheetah-stories.com (Cheetah Stories SA Online Shop).

Goods within the meaning of these GTC are all products and services that can be purchased through an online order in the Cheetah Stories SA Online Shop.

The following GTC do not apply to orders placed with third parties outside of the Cheetah Stories SA Online Shop.

Conclusion of Contract

The presentation of goods in the Cheetah Stories SA Online Shop does not constitute a binding offer to conclude a purchase contract.

Orders can only be placed by persons of legal age. Goods are only supplied in quantities customary for household use.

The minimum order value is CHF 50. Any returns, as well as discounts or other vouchers, are not taken into account.

By placing your order - by clicking the "Purchase" button - you submit a binding offer to purchase. Cheetah Stories SA will send you an automatic acknowledgement of receipt by email, documenting your order. This automatic acknowledgement of receipt merely confirms that your order has been received by Cheetah Stories SA and does not constitute acceptance of your offer.

Depending on the selected payment method, Cheetah Stories SA reserves the right to verify your details regarding the payment method, its validity, your creditworthiness in relation to the order value, and your personal credit limit and, depending on the result of the verification, to refuse order acceptance.

The contract with Cheetah Stories SA is only concluded when Cheetah Stories SA confirms the acceptance of the purchase offer by a separate email. The acceptance period is a maximum of 7 calendar days.

If delivery of the goods you ordered is not possible, Cheetah Stories SA will refrain from issuing a declaration of acceptance. In this case, no contract is concluded. Cheetah Stories SA will inform you immediately and refund any consideration already received.

The contract is concluded exclusively in English and German.

Your order data will be stored with Cheetah Stories SA in accordance with the applicable legal requirements. If you have registered in the Cheetah Stories SA Online Shop, you can view your order data under "My Cheetah Story". If you lose your documents relating to your orders, please contact Cheetah Stories SA by email at standtall@cheetah-stories.com. Cheetah Stories SA will gladly send you a copy of the stored data of your order.

Voluntary Return Policy

Refer to the Cheetah Stories SA Return Policy for further guidance.

Cheetah Stories SA grants its customers a voluntary right of return of 14 days from receipt of the goods subject to the following terms. With this return policy, you can withdraw from the contract by returning the goods to Cheetah Stories SA within 14 days of receipt (the grace period begins the day after receipt of the goods). Timely dispatch is sufficient to meet the deadline.

All returns are subject to the Cheetah Stories SA Return Policy. In particular, Cheetah Stories SA only offers compensation if goods are returned due to manufacturing issues and are in-stock items. For made-to-order items, Cheetah Stories SA only offers store credit as compensation.

For simplicity, Cheetah Stories SA requests that you return goods using the return slip and the return papers included with each delivery to the address indicated there. Additionally, Cheetah Stories SA asks you to return the goods in the shoebox using the same shipping carton you received. Acceptance of returned goods does not imply acknowledgement of any defect claims.

Please note that in the case of deterioration of the goods, you may be liable for compensation. You can avoid any obligation to compensate by refraining from doing anything that impairs the value of the goods and not using the item as your property. Otherwise, you should only try on or inspect the goods as you might in a store. In particular, shoes should only be tried on a carpet or towel, and the protective film should not be removed. Cheetah Stories SA reserves the right to refuse the return of shoes with a removed protective film.

Please note that product packaging, such as protective bags for shoes, vanity kits, and high-quality shoe boxes, are considered part of the ordered goods. If these product packages are not returned or if these items are damaged in the event of a return, this may lead to significant deterioration of the goods. In these cases, Cheetah Stories SA reserves the right to demand the return of the product packaging or to claim compensation.

The voluntary return policy does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the customer is decisive or which are clearly tailored to the personal needs of the customer, including tailor-made footwear or engraved accessories. Furthermore, the 14-day return policy does not apply to repair items (vanity kit) or sealed products if the seal has been removed or damaged after delivery.

Cheetah Stories SA will review your purchasing behaviour at regular intervals. If a return threshold of more than 50% of your last online purchases over a period of up to 12 months is exceeded, Cheetah Stories SA reserves the right to temporarily or permanently block your customer account.

The customer is generally not entitled to a right of withdrawal of the order. However, Cheetah Stories allows withdrawal of in-stock items within 48 hours. Made-to-order items cannot be withdrawn at all because the production process starts right after the acceptance of purchase.

Retention of Title

The goods remain the property of Cheetah Stories SA until full payment is made and the order is accepted.

Delivery

Cheetah Stories SA currently ships goods to Switzerland, the European Union and Internationally, except for Iran, Iraq, Cuba, North Korea, Russia, Syria, Sudan, Iraq, Lebanon, Libya, Afghanistan, Burma, Central African Republic, Ethiopia, Nicaragua, Mali, South Sudan, Somalia, Yemen, Venezuela, Belarus, Israel and the Occupied Palestinian Territories. Depending on the limitations of our logistics provider, other countries may be excluded; if that concerns you, we will inform you in due time and fully reimburse you.

Delivery times vary between in-stock and made-to-order items and are indicated in the Cheetah Stories SA Online Shop and confirmation email. Delivery times also depend on the delivery address. You will be informed of the delivery time once your purchase has been handed over to our carrier.

Prices / Customs Duties / Shipping Costs

The prices listed in the offer at the time of the order apply.

All prices listed in the Cheetah Stories SA Online Shop are Swiss Francs and include the statutory VAT at the legally prescribed rate for Switzerland and the EU. For all other countries, we do not charge VAT, you will receive a separate invoice for your VAT payment from your government.

Cheetah Stories ships from Switzerland and the European Union; therefore, no customs duties apply to purchases delivered within Switzerland and the European Union.

Customs duties are charged separately on purchases delivered outside Switzerland and the European Union and are borne by the customer. These can be calculated using the following online tool using HS code 6402.99.3165.

Any additional costs, such as delivery and shipping costs, are shown separately. Cheetah Stories SA bears the shipping costs for Switzerland and the European Union. For all other countries, the customer bears the shipping costs. Our service and shipping costs are also indicated in the order form.

Payment Terms, Payment Methods

You can pay by credit card. Your credit card will be charged upon completion of the purchase offer. We accept Visa Card, Master Card, American Express and Diner’s Club.

Unless otherwise agreed, the purchase price is due immediately upon completion of the order.

If the payment is not due upon completion of the order, Cheetah Stories SA is entitled to charge a reminder fee of up to CHF 30.- per payment reminder as well as other costs, such as collection costs.

If Cheetah Stories SA can prove that it has incurred higher damage due to default, Cheetah Stories SA is entitled to claim this.

Warranty

Cheetah Stories SA is liable for material and legal defects according to the applicable statutory provisions, particularly Art. 197 et seq. OR. The right to warranty must be asserted in court within two years. The period begins on the day the goods are delivered, but for legal defects, only on the day the customer becomes aware of the defect.

Copyrights

The content and structure of the Cheetah Stories SA Online Shop and other websites operated by Cheetah Stories SA are protected by copyright. All texts, images, graphics, sound, video, and animation files are subject to copyright, trademark law, and other laws protecting intellectual property. Some internet pages also contain images, graphics, sound, video, and animation files subject to copyright, trademark law, and other laws protecting the intellectual property of those who provided them. Copying or other use for purposes other than private use or for distribution, publication, reproduction, and dissemination, whether in original or altered form and any medium, or such use on other websites, is not permitted without the prior express written consent of Cheetah Stories SA.

Data Protection

The regulations concerning data protection and data security are in the separate privacy policy.  The privacy policy can be saved and/or printed by the customer for the purpose of online ordering.

Promotional Vouchers and Their Redemption

Promotional vouchers are vouchers that cannot be purchased but are issued by Cheetah Stories SA as part of advertising campaigns with a specific validity period.

Promotional vouchers are only redeemable during the specified period and only once within the framework of an order process. Individual goods may be excluded from the voucher promotion. Promotional vouchers cannot be used for the purchase of gift vouchers. Please note that promotional vouchers may be subject to a minimum order value.

The value of the goods must be at least equal to the amount of the promotional voucher. Any difference in the higher value of the goods can be balanced with the payment options offered. The value of a promotional voucher is neither paid out in cash nor bears interest. The promotional voucher will not be refunded if goods are returned in whole or in part.

Promotional vouchers can only be redeemed before the conclusion of the order process. Subsequent crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined unless Cheetah Stories SA has agreed otherwise.

If you used a promotional voucher for your purchase, Cheetah Stories SA reserves the right to charge you the original price of the goods you keep if - due to your return - the total value of the order falls below the respective value of the promotional voucher.

Miscellaneous

Swiss law applies to the exclusion of the principles of conflicts of laws thereof and the UN Sales Convention (CISG).

If the customer has no general place of jurisdiction in the country (Switzerland) or has moved his residence abroad after conclusion of the contract or if his residence is not known at the time of filing a lawsuit or if the customer is a merchant and acts in this capacity, the place of jurisdiction for all disputes is Bellinzona, Switzerland.

Should individual provisions of this contract with the customer, including these General Terms and Conditions, be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
